Please read these terms carefully. They contain important limitations of liability, compliance statutes, and binding software licenses.
1. Acceptance of Terms & Log Consent
By accessing, registering an account, or purchasing a pass for the SavvyWoofer 3D Enclosure Builder (the "Software"), operated by SavvyTech ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. You acknowledge that we actively monitor and log IP addresses, device identifiers, and session activity to prevent fraud, account sharing, and intellectual property theft. These terms are governed exclusively by the laws of the Republic of South Africa.
2. Comprehensive Software Licensing (SaaS-EULA)
In terms of Section 13 of the South African Electronic Communications and Transactions Act (ECT Act 25 of 2002), accessing and subscribing to SavvyWoofer constitutes a legally binding agreement to the following End User License Terms. The Software is licensed, not sold.
A. Grant of License & Seat Limits
SavvyTech grants you a limited, revocable, non-exclusive, non-transferable license to access the Software. Individual plans (DIY Maker, Passes) are strictly for single-user access. Business plans (Pro Installer, Workshop Team) are limited to the specific number of employee seats purchased. Sharing login credentials across multiple unverified IP addresses will trigger automated account suspension.
B. Strict Restrictions on Use (CPA Section 49 Notice)
You are explicitly prohibited from: (1) Copying, decompiling, framing, or reverse-engineering any part of the Software; (2) Using automated scrapers, bots, or spiders to extract our vehicle database, driver parameters, or acoustic formulas; (3) Creating derivative works, cloning the platform, or building competing software using our proprietary workflows. Violation will result in immediate termination without refund, and SavvyTech will pursue maximum damages under South African IP law.
C. Ownership of Output vs. Core Intellectual Property
You retain full ownership of the unique customer data, custom box dimensions, and branding assets you upload to your CRM. However, SavvyTech retains 100% exclusive ownership of the underlying software code, 3D WebGL visualizer engine, DXF export generation algorithms, and the acoustic Helmholtz resonance formulas, which are protected under the South African Copyright Act 98 of 1978.
3. Reselling, White-Labeling & Redistribution
Your subscription is for direct use only. You may not resell, sub-license, host, or redistribute the Software as a service to third parties. Attempting to sell access to your SavvyWoofer account is a direct breach of this agreement.
Official Reseller & Enterprise Programs
We welcome partnerships. If you want to legally integrate SavvyWoofer into your brand, offer it to your franchise network, or utilize our Enterprise White-Labeling (custom domains and hidden SavvyWoofer branding), you must contact us directly to establish a formal Reseller Agreement:
4. Refund Policy & Digital Goods Consumption
Because SavvyWoofer is a digital software service that delivers immediate access to proprietary calculators and exportable CNC files, our refund policy is strictly enforced.
- ✗No Refunds for Usage: We maintain strict server logs of IP addresses, login timestamps, 3D builder activity, and PDF/DXF exports. If our logs show that you have logged in and utilized the builder in any capacity, no refund will be provided under any circumstances.
- ✗"Not Happy" is Not a Condition for Refund: If the software does not meet your personal preferences, you are welcome to submit feature requests or suggestions to our support team. We do not issue refunds simply because a user dislikes the UI or workflow.
- ✓The Toddler Clause (Accidental Purchases): If your two-year-old child grabbed your phone while you were in the bathroom and mashed the PayFast button, contact us within 24 hours. Provided our server logs show absolute zero activity or exports on your account following the payment, we will gladly reverse the transaction.
5. Limitation of Liability & Physical Damage
SavvyWoofer provides mathematical models, cut lists, and tuning frequency (Fb) estimates as a digital guide. Custom audio fabrication carries significant physical and financial risks.
1. Measure Twice, Cut Once: You are solely responsible for verifying all physical measurements, vehicle boot clearances, material densities, and subwoofer mounting depths before purchasing or cutting MDF/wood. We do not refund wasted material costs.
2. Equipment & Acoustic Damage: SavvyTech is strictly not liable for blown subwoofers, melted voice coils, damaged amplifiers, electrical fires, or hearing loss resulting from enclosures built using our dimensions.
3. Assumption of Risk (CPA Sec 49 Notice): The Software is provided "AS IS" without warranties of any kind. We do not guarantee that your completed physical enclosure will sound exactly as projected. Acoustic results vary wildly based on vehicle cabin gain, electrical voltage drops, construction quality (e.g., air leaks, flex, bracing), and amplifier clipping. Execution of physical builds and reliance on the software's math is strictly at your own risk.
6. Data Protection & POPIA Compliance
We are fully committed to protecting your privacy in accordance with the Protection of Personal Information Act (POPIA) of South Africa.
- Data Collection: We collect strictly necessary information, including email addresses, billing details, IP addresses, and customer CRM data inputted by shop owners.
- Data Usage: Your data is used exclusively to provide software functionality, authenticate sessions, process billing, and send system notifications. We will never sell your personal or client data to third parties.
- Security & Storage: Data is encrypted in transit and at rest on secure cloud servers. Shop owners using our CRM are independently responsible for ensuring they have consent from their clients to store their details within the SavvyWoofer tenant workspace.
- Right to be Forgotten: You may request complete account deletion at any time, subject to our legal obligation to retain basic transactional records for SARS tax compliance purposes.
7. Statutory Seller Disclosures (ECT Act Sec 43)
